Italy was the first EU country to temporarily ban ChatGPT in 2023, and the regulator continues to pay close attention to how AI tools handle personal data. An SMB unknowingly funneling client information through an unapproved AI service is exactly the kind of case that attracts enforcement attention.

When employees input proprietary information — product designs, business strategies, source code, financial models — into AI tools, that data may be used to train future models or could be exposed through data breaches. Provide approved alternatives

For every shadow AI use case you uncover, offer a sanctioned alternative. This might mean subscribing to enterprise versions of AI tools that include data processing agreements, EU-based hosting, and audit logs. The cost of providing proper tools is a fraction of the cost of a data breach or regulatory fine.

Train continuously, not once

A single training session will not change behavior. Build AI literacy into your regular operations. Share real examples of shadow AI risks. Celebrate teams that find innovative, compliant ways to use AI. Make governance feel like enablement, not restriction.

The EU regulatory landscape is tightening

European SMBs operate in one of the most regulated AI environments in the world. The EU AI Act introduces obligations that cascade down to businesses of all sizes, particularly those deploying high-risk AI systems. National authorities like Italy’s Garante and AgID (Agenzia per l’Italia Digitale) are developing sector-specific guidelines that will further define acceptable AI use.

Waiting to address shadow AI until regulations are fully enforced is a losing strategy. Companies that build governance structures now will be better positioned to comply, adapt, and compete. Those that ignore the problem are accumulating risk with every unapproved prompt their employees type into a chatbot.
